Their insurance is covering my orthopedic surgery on both knees...since the company went out of business, do i still get a settlement award when my case closes?I have a Workman's comp case opened in California...The company i work for went out of business.?
OK, the insurance company is still on the hook for any eligible benefits, however, you don't get pain %26amp; suffering with workers comp.
So your employer going out of business, doesn't affect your claim. Unless you were with a self insured plan.I have a Workman's comp case opened in California...The company i work for went out of business.?
~~In California every employer MUST carry WC insurance on every employee. They will continue covering all your needs because this falls to the WC insurance company. Does not matter if the business is closed or not.
The company closing will not affect or change the outcome of your settlement. The WC insurance has to follow all the states guidelines, and you will be awarded appropriately.~~
Their WC insurance policy should still cover it as long as it was in force at the time of your injury.
