Business Studies AQA GCSE Exam, Are We Supposed To Have Recieved A Case Study?

Ok, this is kinda strange to ask, but I am panicing.


I've looked at a few similar questions, and one stated that they had a case study on ';Kellogs'; for their AQA Business Studies Exam Tomorrow.


I am sitting that exam, but noone in my class has been given a case study.


Is it necessary to have recieved one? Or am I just panicing for no reason?


Our teacher has been ill for about 2 weeks so we've had no help and I think the majority of us are going to fail :(Business Studies AQA GCSE Exam, Are We Supposed To Have Recieved A Case Study?

Where could i find law cases or jurisprudence about business transportation?

Go to your county law library. Unless you are familiar with looking up cases online you'll waste a lot of time. But http://www.findlaw.com/# and http://www.lexisone.com have a lot of free stuff. Can I put business in siblings name, to protect it in case of divorce?

My husband and I have a very rocky marriage and I never know what to expect of him. I hope to avoid divorce, who doesn't but if it were ever to come to that can I put my business in a siblings or friends name to protect it in case of divorce?? I want to start a business and if I register it all under someone else and I will be the employee even though I will be running it, is that ok? Or can my husband take this to court? You REALLY need to talk to a lawyer about this.
If you are an investor, once you're in divorce proceedings, you'll have to list that business as an asset. Even if you register it under others' names, you'll still be putting money into the company, you'll still be an owner, and would have to reveal that to the court.
Don't trust anyone. You just may be an employee or your friend or sibling may fire you and take it all.
Things procurred together during a marriage are divisible. If you sell something the two of you obtained during your marriage or both worked on, even without her knowledge, it won't protect it but it will complicate things.

    I have an accepted offer to purchase a 4-plex. Initially the seller's RE agent mentioned all units are being occupied. However, I only received 3 tenant acknowledgments today and found out from him that one apartment is vacant.





    If I knew one unit is vacant I would not agree to close end of this month but rather end of next month in order to allow enough time to find a new tenant. Should I ask to postpone closing day by one month? does it complicate things financing-wise or not really?


    (I do not even have to purchase as I did not waive conditions yet.)





    Lastly, do you agree I should ask permission to look for a tenant myself and not let the owner try to find a tenant for me?

    Don't have the seller or agent find you a tenant in a hurry. They'll walk away leaving you with a dodgy tenant.





    Are you buying this stuff on borrowed money? Ooer. That's a bit scary.





    What I'd do to be perfectly honest is put a guesstimate on 3 months rent, and have them take that off the price, and buy exactly when you said you would. Then you've got 3 months to find yourself a great new tenant who you can trust, move them in etc etc etc.

    I apologize for being so harsh, but by the mere asking of the question, I can see you have never really purchased income property before.


    You don't have enough knowledge (yet), and you are getting yourself into world of financial hurt.


    Walk away from this deal, and educate yourself on multi-unit properties.
    The question is whether misrepresentation regarding the no. of tenants put you in some way at a disadvantage. It's certainly a material term sufficient to block the deal. If you prefer to find your own tenant and nothing else grates, carry on full steam ahead. Unfortunately, quite often where's there's smoke, there's fire. One misrepresentation is often indication that there are others. Investigate further before you sign anything.

    I got a call at work a few weeks ago. It was a hugely busy time of the month. This guy whose accent I can barely understand starts talking to me about yellow pages, asking me to confirm our address and phone number. I'm used to this call, so I just say yes and yes and get ready to hang up. Then he tells me he's transferring me to shipping. Then I'm asked if I'm authorized to make the purchase. I say I don't think so, that they should call back when my boss is in. They start hassling me, I say I'm really busy and that I can't do this right now. They call back again a few days later. Again, I say I don't think I can. They say that my boss is already a client of theirs and that all I'm doing is saying an invoice can be sent and that nothing will be charged. I say fine, whatever, and then they put me on record (this is obviously where the trouble starts) and ask me if I'm authorized to ask for an invoice or something.

    It is a scam, it's been around for years, and don't worry. The way the scam works is that they confirm info and get a name, then send a bill. All your company has to do is send the bill back saying that your company doesn't pay invoices without a valid purchase order number, then keep a copy of the bill and send it to the BBB.I'm a lowly employee and I think I got my business scammed!     Okay, this is the OP, apparently I'm so long winded I ran out of space....





    So, I'm asked if I'm authorized, and since I was told nothing was being charged or purchased, I just said yes.





    So today, I open up a piece of mail addressed to me from this place. This is the first thing that really alerts me to something not being right. Someone, I'm not sure if it's me or the company, is being charged for nearly $500. I call, ask some questions, tell them I was told I was told nothing was being purchased, and they give me the whole ';Recorded your conversation, legal binding'; spiel.





    So, I know that, legally, verbal contracts are binding and all, but in this case, it wouldn't stand up in court, right? My boss is out of town for the weekend, so when she comes back on Monday I want to give her some assurance that I know what I'm talking about when I confess that I frakked up, and assure her that I know what's up and that we aren't completely screwed. I think knowing something and being able to say something assuring about it is the only thing that's going to keep me from bursting into tears when I tell her what happened.

    In the future, you should be more skeptical of any calls received at work. Don't answer their questions. Luckily, where I work, my boss set up an extension for a fake employee. Any time we get a telemarketer asking for whoever is in charge of (whatever it is they're trying to sell), we just tell them it is Mortimer and transfer the call to the extension. When we're bored, we listen to the messages they leave. It's entertaining. The fake employee actually gets mail once in a while and maybe once a year, someone will come to the office looking for him.

    It is late summer and National Motors, an auto manufacturer, is facing a financial crisis.


    A large issue of bonds payable will mature next March, and the company must issue


    stock or new bonds to raise the money to retire this debt. Unfortunately, profits and cash


    flows have been declining over recent years. Management fears that if cash flows and


    profits do not improve in the current year, the company will not be able to raise the


    capital needed to replace the maturing bonds. Therefore, members of management have


    made the following proposals to improve the cash flows and profitability that will be


    reported in the financial statements dated this coming December 31, 2003.


    1. Switch from the LIFO method to the FIFO method of valuing inventories.


    Management estimates that the FIFO method will result in the lower cost of goods


    sold but in higher income taxes fro the current year. However, the additional


    income taxes will not actually be paid until early next year.


    2. Switch from the 150%-declining 鈥揵alance method of depreciation to the straightline

    5. Pass up cash discounts offered for prompt payment (that is 2/10, n/30), and do not


    pay any bills until the final due date.


    6. Borrow at current short-term interest rates (about 10%) and use the proceeds to


    pay off long-term debt bearing an interest rate of 13%.


    7. Substitute stock dividends for cash dividends currently paid on capital stock.

    Do you live in a community property state?


    - Can you register your business to your name, a married person, as your separate estate?


    - Can you have your husband sign a quit claim to any interest in the business now?





    Whoever the business is registered to is responsible to pay the taxes etc on the business and owns it.


    Either it is you or not, but if you try to hide assets %26amp; then lose them to the other person, don't whine about it.





    Your husband can take anything he thinks he knows to court. If he believes the ownership to be a front, he can certainly raise that %26amp; you would have to spend time and legal fees to prove otherwise.





    Why not get the divorce %26amp; then open your business?     Your best answer will come from a lawyer in the state where you reside. You can probably find a legal-aid resource if you contact your local Bar Association. Your Small Business Administration office may also be able to find the answers you need regarding the legalities involved.

    While on a business trip my husband purchased an Xbox carrying case?

    I had to travel from the East Coast to the West Coast and blindly try to find a home for us while he stayed behind to work. I stayed for two weeks. We had little finances for this trip and as it was i had to dig into our credit card for the plane flight and find the cheapest flight there was. I also had to cash in my large change ';jar'; i had been saving up or over two years to have money to pay for expenses while there. Before i left he took a portion of that money from me that he said he would need for groceries and other things. I am always a sucker for being sure he is left with cash on hand. I was very frugal the entire trip and ended up leaving with just under $200 of $300 i cashed in and coming home with $20 of which he quickly snatched up. I found out last night after being home for several days he purchased a $30 Xbox carrying case for his game system. This was a purchase he never told me about. If i would have known about this i would never have bought him Dodger souvenirs while out of town. We kept in contact the entire time and not once did he mention this xbox purchase until i noticed the case last night. When i confronted him he got very angry and told me it was a situation he was very unhappy about because he was expecting other money to come in and it never came through. I asked him why he did not return the case after the money did not come through and he only got angrier. I guess i am unhappy because when i go to make purchases they are necessary and for the household and have to go on the card or i have to borrow the money. He also did not tell me about this. He is trying to justify it. He says he had little money and that he used any monies he had here to buy groceries while i was gone.     Money can be a big issue in marriage. We all have different ideas on what is important and what to spend our money on. You need to sit down with him and work our a reasonable budget. Yes, a person can switch addictions, that isn't uncommon. Sounds more like he just has never learned how to be responsible with money though. Many cities have services (many are non-profit and don't charge anything) to help with setting up a budget that you can both agree on. Once that is done, things should be easier. Ask him to make a commitment with you to agree to a certain dollar amount you can each spend without discussing it with the other, say maybe 20.00 or so - anything over that it has to be decided together.     Having the business Owner's name on my Small Calims case -- can i keep him on it?

    I recently won a small claims case against a business....i won by default judgment because the business never bothered to file a defense or take it seriously. Now that i have won and am bound to collect the business is taking it seriously and the first course of action they are trying to do is to have the owner's name removed from the case (as well as filing a motion to set aside the default judgment). When i filed my case i not only put the business name as the defendant but also added a 2nd defendant: the Owner himself.





    To give you insight, this business was to do contract work on my home...they never bothered and so i am suing it. I wanted to put the owner on the case as well because i feared that by suing just the company this business would just claim bankruptcy and change its name and i would see nothing. By having the owners name i could go after him exclusively...Is that allowed or acceptable? I fear this is what he is planning on doing (claim bankruptcy or justHaving the business Owner's name on my Small Calims case -- can i keep him on it?
    If the business is a corporation the owner is normally protected from lawsuits. If the business is a sole proprietorship then you can sue the owner as well.





    Changing the name of the company would not absolve them of the judgment. Selling the business would not either, the new owners would also acquire the debt. Bankruptcy could help them avoid paying you some of what is owed, however since you have a judgment you are at the head of the line as they sell of all of the businesses assets to settle the debts of the business.Having the business Owner's name on my Small Calims case -- can i keep him on it?
    Don't let them convince you that you have to delete him or something. The bottom line is that you COULD have deleted his name or not included him in the suit, but now that you have a judgment, it's on him to pay up or pay the consequences. He should have said something earlier if he wasn't the actual culprit. Just stick to your guns, you're doing the right thing.

    No, you should nott ask for a reduction, the building value is not changed a dime, you are buying the exact same thing.

    You have a signed contract for a specific purchase price. You cannot ask to change that price after you %26amp; the seller have both signed the contract. You could ask to extend the closing but there's no guarantee that there will be a tenant moving in on the first of next month. Plan on closing as scheduled and ask the agent to see if the seller is trying to rent it.
    You get NO reduction, unless your offer to purchase specifically indicates that all four units are occupied and must remain so on closing date. You are buying a property, and the property doesn't include tenants.





    Depending on what sort of contingencies you have outstanding, you MAY be able to get out of your contract.

    Depends which country you live in. In the UK:





    1. It depends what senior position you were in. If you were of a sufficiently senior level (i.e. approaching executive level) then recent caselaw indicates there may be an argument you owed fiduciary duties which were breached even if you only took steps towards starting a business in competition with the employer.





    2. If you were not of particularly high level, then the contractual term they are probably talking about is either Confidentiality, or the implied term of trust and confidence. That indicates to me that the company is saying that you were taking steps towards starting your own business, that were in conflict with the duty that you owed to act in the company's best interests - for example downloading client lists, syphoning clients off towards your own company etc.





    If you did not do that, and you genuinely were just taking basic steps such as registering a company then this may be an unfair dismissal situation. But if you were in breach of fiduciary duties, or you were actually competing whilst remaining employed by the employer, then it was probably a fair dismissal.





    You should examine your own conduct critically, and decide for yourself whether your actions went beyond mere 'setting up' and became actual competitive behaviour. If it was just setting up then seek good legal advice (by which I mean go to somebody listed in Legal 500 who does restrictive covenant work, not somebody on the high street who dabbles - this is not a straightforward employment law situation).I was sacked for thinking about looking into my own business, do i have an unfair dismissal case ?
    the business was not set up or even running, i was just floating the idea to see if it was an option. didnt even have time to do anything else about it before i was sent home by my boss to think about it, had a phone call 2 days later and was suspended even though i said i had stopped all interest.

    Looking at it from your point of view it does seem unfair and I would say you may have a case but there may be more to your dismissal than you have spoken about. You need to get a written copy of the exact reasons and then seek legal advice.
    Go to a Citizenship information office. They will be able to help you and give you free advice!





    All depends on your contract really, but what they did was unfair, especially since you were working there for so long.
    The way you put it, it does seem unfair. I, too suspect that in fact there's more to it than just that.
    Maybe they've given you that incentive you need to now start your own business.
    Prolly not, I can fire someone for whatever reason I choose as long as it isn't biased by race or gender etc.
    Which country are you in? Did the company hold a meeting with you? Did you get the chance to appeal?
    Its not unfair behaviour if u used work time to do your work. Its called stealing . They pay u for your time. If its out of work hours and is not a threat to the competition of your employer then you have a case.


    You can not sack someone based on race gender or religion, the above answer is correct but there are also managerial issues that come into play.


    Were you counselled by managment about the issue and given written warnings to help you prevent the behaviour at hand.


    Was a pattern of behaviour present and not a single act.


    Sometimes race religion do not come into it but bad management and enforcement of policys that cause an unfair dismissal.


    In your case i would go to the work tribunal in your area the way i see it what have u got to lose anyway u lost your job they cant take anything else.
    talk to your local CAB, they will put in touch with a local employment law specialist/lawyer.. who will have a field day with this one.

    - an conflict or use of specific information/contacts that you meet and use in the normal execution of your job.





    If there had been conflicts, even without permission, you should really only have expected to be requested to desist in the activities, and possibly hand them over to the company as being company derived product. (though again , contract and legal argument dependant, mostly companies get around this, by just buying the idea for a nominal small sum).





    You need legal help, and a specialist in employment law.


    go ask a local solicitor if you can;t get through to CAB.


    AND start writing a diary/notebook of when/where/how and what was said to date, before you forget it (it may take some re-working time..as you keep remembering extra bits)


    and everything that happens from now on.


    - if you go to any meeting with the company or company person (even if it appears social/from the management) always take a witness


    - Did the company follow their internal disciplinary process


    - Did you have a witness of your own


    - were you provided with copies (in advance) of the process, and procedure


    if not,. can you get them now.. for your reference only.








    You also need to think on two more things.


    - why were they so keen to get rid of you (were they just looking for an excuse ?)


    - would you really want to go back and work for them ?


    or is this simply a case of HR jumping into what was an otherwise happy work environment ?

    You have the minimum 2 years full time employment, you are protected.

    Employment law isn't my area but that sounds like unfair dismissal. If you were required to get the managers permission you did that so you did nothing wrong. If you were required to get a particular managers permission then the other manager was negligent in saying you could. It is possible the court will hold that the contract should not operate to restrain trade in those circumstances. More likely you would have to pursue a claim for negligence against the company, who are vicariously liable for the negligence of the manager in telling you you would do this.

    Law school does not require a certain type of degree. Think about what type of law you would like to practice when you are considering a major. If you are interested in corporate and business type law, a business degree makes sense. It isn't necessary though.





    Lawyers must be able to communicate effectively in order to represent their clients. Business courses don't really focus on that as much as some other degrees. If you get a business degree,and want to build your written language skills or other communications skills, you may want to consider a minor that can help, such as English or Communications.





    The main thing is to pass the LSAT exam. There are study guides and manuals that can be purchased at most bookstores that will give you a good idea of what you need to know to get into law school.

It won't be publicized that a complaint was registered, unless of course there was a question of ';merit'; which does not, I repeat, does NOT include asking for paid vacation. I love the answers you got on the other question about ppl who wouldn't pay you for a week vacation - I absolutely would, and I feel you are entitled to it, the same as everyone else. You may have to reword your contract now though because of the bad publicity that the individual is showering you with. You may have to have the ';one week paid vacation'; right next to the ';allowance of one week unpaid'; clause that you spoke of. That way it can be argued that you aren't able to coordinate your vacation time with all of the parents vacation times coinciding. Everyone would be okay with that.

    I recently purchased a business and after escrow closed I got a CAM reconcilliation overdue bill from the landlord for months prior to me taking over. I spoke with the owner and he said he would pay it but it's been 5 months and no payment (I have email confirmations from him.) The landlord is saying that i am responsible since I bought the ';business'; and that I assumed all legal liability. Regardless i need to pay before they terminate my lease but I was wondering how this got passed escrow and is there a way for me to collect the money from the previous owner?Do I have a case?     I purchased a business a couple years ago, and faced EXACTLY the same situation - the landlord tried to collect the CAMS from me that the previous owner owed.





    I pointed out to them that although I had purchased the store, I am legally a different entity (the store was a sole proprietorship), and I cannot be liable for the previous owner's debt. They stopped trying to collect from me.





    Of course, it also helped that the purchase agreement clearly stated that I was not liable for any undisclosed debts owed by the previous owner.

    I've been working on starting my own creative arts business for a little over but have yet to take the final steps to get it off the ground.





    Basically, the final steps will cost a fairly high amount of money $3,000-$5,000.





    I have the option of taking out a loan but would rather avoid the interest if possible.





    I have aprox. $20,000 in savings with about 1/3 of it tied up in CDs. I could pull from this but would like to earn the interest on it and avoid using it unless I need a backup. The other option I'm considering is getting a second business credit card (already have one) which offers me 0% ARP until Decemer 2009. I figure I can work it so that I can get what would essentially amount to a cash advance (still at 0%) of the amount I need and only have to make minimum payments until December 2009 when I could pay it off and have still earned on my savings for more than a year.

    I'm with Emily, use your savings.
    I would suggest that you incorporate your business in the state of Delaware (you don't have to live in Delaware to incorporate there, they don't require any state taxes so many people incorporate there). Once you incorporated build up your corporate credit and use that to start your business. The reason why is that corporations have their own tax identification numbers and are considered - its own entity, its seen as its own person and anything it does cannot affect you personally. Say if your business doesn't work out and you have trouble paying back your start-up costs, a creditor could never come after your house or attack your personal credit.





    To answer your question directly, if that business credit card is tied to an incorporated business then, yes, I would pull from that. Truly successful people never make any moves with their own money. Which is why Donald Trump can file bankruptcy again and again and remain unaffected (he's incorporate and its not his money).

There are lots of different areas in Business, including Human Resources, Marketing and International Business, all of which require specialized courses and ideally work-experience organized through your university. The best thing to do is talk to a career counsellor, and also see what your local post-secondary institutions specialize in.





    My best advice would be for Business students to complete a Bachelor of Commerce degree, because a Bachelor of Arts degree in Business is not highly regarded.     You don't have a case. You must first prove a history of biased actions to non whites before you can even start a civil rights case. Without a history of racism you have nothing.     Let this one go, because I have a strong feeling it's like what Lawrence answered. We have lots of fancy spas and casino spas where I live, and I know people that do this for a living. None of these places ever allow a student or trainee to do a massage on a member of the opposite sex without someone else in the room to witness. This is because of bogus sexual harrassment lawsuits; people will claim that the massuese ';touched them innappropriately'; during the massage.
